1. Acceptance of Terms
Please review the following Terms of Use carefully. These Terms of Use govern all use of and reliance upon the Support Match NB website.
All users must accept these terms of use to proceed with registration and use the site. By using the website in any way, I acknowledge that I am agreeing to comply with the Terms of Use. Should I object to any term or condition of the Terms of Use, or any subsequent modifications thereto or become dissatisfied with the site in any way, I acknowledge that my only recourse is to immediately discontinue using the site. The New Brunswick Association for Community Living has the right, but not the obligation, to strictly enforce these Terms of Use through investigation, litigation and prosecution.
Support Match NB is a publicly accessible internet site undertaken as a pilot project by the New Brunswick Association for Community Living. Support Match NB aims to join individuals and families seeking support workers and support workers seeking to provide support worker services.. I understand that the New Brunswick Association for Community Living is not involved in the transactions between families and support workers, and does not interview families or support workers. The New Brunswick Association for Community Living does not monitor the postings of jobs or support worker profiles, and does not guarantee that mutually suitable support matches will be obtained through use of this service.
Individuals/families:
I acknowledge that it is recommended that individuals/families using this site conduct a criminal record check and vulnerable sector search, background screening and reference checks before hiring support workers found on this site, and make any other investigation they feel is necessary or appropriate before hiring support workers. I understand that any decision I make to hire a support worker is my own decision. I acknowledge that there are inherent risks associated with hiring a support worker through an internet site and I indemnify and hold the New Brunswick Association for Community Living harmless for any choice I make. I understand that any information posted on this site by third parties is the sole responsibility of the person from whom the information originated: the New Brunswick Association for Community Living makes no representation or warranty as to the accuracy, completeness or authenticity of such information. I understand that I am solely responsible for any information that I submit and I agree to only submit information that is true and accurate. I will not post inappropriate information such as material that is obscene, defamatory, threatening, harassing, abusive, embarrassing, or otherwise inappropriate including any discriminatory content based on gender, race, sexual orientation, religious affiliation, disability, ethnicity, or family status. I will not post confidential third party information, or any sensitive or personal information, unless it is with the owner’s consent. I will not use Support Match NB in connection with contests, surveys, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
Support workers:
As a support worker, I acknowledge that any decision I make to work with an individual/family is my own decision. I acknowledge that there are inherent risks associated with working for an employer found through an internet site and I indemnify and hold the New Brunswick Association for Community Living harmless for any choice I make. I understand that once information is posted on Support Match NB, the New Brunswick Association for Community Living cannot control how third parties, including individuals/families, will use the information. As a result, I understand that there are risks associated in dealing with users with whom I come in contact through this site and I accept those risks. Although all reasonable means are taken to protect personal information, the New Brunswick Association for Community Living is not responsible for any improper use of personal information that is beyond the New Brunswick Association for Community Living’s reasonable control.
I am 18 years or older and I am legally entitled to work in Canada. I understand that I am solely responsible for any information that I submit and I agree to only submit information that is true and accurate. I will not post inappropriate information such as material that is obscene, defamatory, threatening, harassing, abusive, embarrassing, or otherwise inappropriate including any discriminatory content based on gender, race, sexual orientation, religious affiliation, disability, ethnicity, or family status. I will not post confidential third party information, or any sensitive or personal information, unless it is with the owner’s consent. I will not use Support Match NB in connection with contests, surveys, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
2. Indemnity
I agree to indemnify and hold harmless the New Brunswick Association for Community Living, and its affiliates, directors, officers, agents, partners and employees from any and all liability including all claims alleging loss, costs, expenses, and damages arising out of my use of this Site. I understand and agree that the New Brunswick Association for Community Living is under no obligation to become involved in any disputes as between support workers and individuals/families that is in any way connected to this site, and I further agree to indemnify and hold harmless the New Brunswick Association for Community Living from any and all liability arising out of such disputes.
3. My username / Password
I will maintain the confidentiality of my password and username. I agree not to provide any other individual access to Support Match NB via my login information. I will not create a false identity for the purpose of misleading others as to the identity of the sender or the origin of any communication. I understand that I am fully responsible for all activities that occur under my username and password. I will immediately notify the New Brunswick Association for Community Living through Support Match NB of any unauthorized use of either my username or password or any other breach of security and I will ensure that I log out and exit from my account at the end of each session. Support Match NB accepts no liability for any unauthorized or improper use of disclosure of any password and takes no responsibility for the activities on your online account.
4. Termination of Account
I understand that the New Brunswick Association for Community Living, in its sole discretion, has the right (but not the obligation) to terminate my access to this Site and any account or password I may have in connection with this Site. I agree that the New Brunswick Association for Community Living shall not be liable to me or any third party for any termination of my access to the site. I agree not to attempt to use the site after said termination. At such time as the use of the service is discontinued, Support Match NB shall have no obligation to maintain any of the information or content relative to my account.
5. Third Party Internet Sites
This Site contains links to third party websites that are not under the control of the New Brunswick Association for Community Living. I understand that Support Match NB provides these links as a convenience only and the New Brunswick Association for Community Living is not liable for any loss or damage of any sort or responsible for the content or uses of these third party websites. I understand that the New Brunswick Association for Community Living makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. The inclusion of any link does not imply any endorsement by the New Brunswick Association for Community Living of the site or any relationship with their operators. Support Match NB can decline third parties to link to our Site and shall not be required to give any explanation or reason for such refusal.
6. The New Brunswick Association for Community Living’s Proprietary Rights
I understand that the Site and any necessary software used in connection with the Site contain proprietary and confidential information that is protected by applicable intellectual property and other laws including copyright law. I will not attempt to decipher, decompile, appropriate, distribute or create derivative works based on the Site or source code of any of the software available on or through the Site. I further acknowledge and agree that Content contained in sponsor advertisements or information presented to me through the Site or advertisers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as otherwise indicated elsewhere on this Site, I acknowledge that I may view, download, and print the materials available on the Site provided that my registration is in good standing and I am in compliance with these Terms of Use.
7. Disclaimers
I ACKNOWLEDGE THAT ANY USE OF OR RELIANCE ON THIS SITE OR ANY MATERIALS IS COMPLETELY AT MY OWN RISK. The New Brunswick Association for Community Living makes no representation or warranty of any kind regarding the Site and/or the Materials, including with respect to the information provided by third party legal and other consultants, all of which are provided on an “AS IS” basis. You and your family assume full responsibility for the hiring process. Information and advice given through this website should not be substituted for independent legal or professional counsel. The information and advice provided by this website is intended as a guide for individuals/ families and support workers to aid them in a hiring process. The New Brunswick Association for Community Living EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. The New Brunswick Association for Community Living DOES NOT WARRANT THAT THIS SITE WILL CONTINUE TO OPERATE, OPERATE WITHOUT INTERRUPTIONS OR THAT IT WILL BE ERROR-FREE.

In any event, I agree that the New Brunswick Association for Community Living’s aggregate liability for damages shall be limited to $100. I agree that any cause of action I might have arising out of or related to Support Match NB must commence within one (1) year after the cause of action ensues; otherwise, any and all of your causes of action are permanently barred. 9. Privacy Policy
I agree to be bound by the Privacy Policy which explains why my personal information is being collected and how that information will be treated. My use of the site signifies acknowledgement of and agreement to our Privacy Policy.
10. Governing Law and Jurisdiction
This site is controlled by the New Brunswick Association for Community Living from its offices within the province of New Brunswick, Canada. By accessing this Site, I agree that the statutes and laws of the Province of New Brunswick, without regard to the conflicts of laws principles thereof, shall govern all matters relating to my access to, or use of, this Site and any Materials or Services. I also agree and hereby submit to the exclusive personal jurisdiction and venue of the Court of Queen’s Bench of New Brunswick with respect to such matters.
11. No spam permitted
The New Brunswick Association for Community Living will immediately terminate any account which it believes or suspects, in its sole discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email.
12. General
I understand that the New Brunswick Association for Community Living may need to disclose personal information about me to cooperate with law enforcement authorities or to protect the safety of users on the Site. I consent to the disclosure of all personal information for these purposes.
Any unauthorized commercial use of the Service, or the resale of its services, is expressly and absolutely prohibited. The use of the Service by community support agencies or any other organization to recruit individuals for hire for the agencies’ own clientele is not allowed.
If any court defines any provision of these Terms of Use to be unenforceable, that provision shall be enforced to the maximum extent permissible, and the remainder of the Terms of Use shall continue in full force and effect. The Terms of Use constitute the entire agreement between myself and the New Brunswick Association for Community Living. The failure by the New Brunswick Association for Community Living to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
I understand that the New Brunswick Association for Community Living reserves the right, at its sole discretion, to modify these Terms of Use, in whole or in part, at any time. My continued use of this Site after any changes to the Terms of Use are posted means that I accept those changes. Activating “I agree” signifies my acceptance to be bound by these Terms of Use.
By using this site, I agree to the Support Match NB Terms of Use. All Information submitted is subject to our Privacy Policy.
